i.Acceptance
By hiring a Rubber City Studios service you accept these Terms and the Privacy Policy. Party responsible for the service: [pending].
ii.The services
Rubber City Studios offers photography and video, website design and maintenance, CocinaLink (phone order answering and kitchen tablet for restaurants) and phone assistants for businesses.
Each project is agreed in writing in a proposal: what is delivered, in how much time and what your investment is. If the proposal and this page say different things, the proposal governs.
iii.Investment and payments
- The investment for each service is the one shown on this site or in your proposal. It may change over time, but what you already signed is honored.
- Websites: 50% to start and 50% on delivery, unless the proposal says otherwise.
- Monthly services (website maintenance, CocinaLink, assistants) are paid in advance each month.
- If any tax applies, it is added to the investment.
- Cancellation and refund details: Payments and refunds.
iv.What we need from you
To deliver on time we need your content (text, menu, logo, business details), any access required and your answers to review rounds. If any of that is delayed, the delivery date moves by the same amount.
v.Revisions and changes
Each project includes the rounds of changes stated in the proposal. Major changes outside what was agreed are quoted separately before we make them. With monthly website maintenance, small changes (menu, hours, photos) are done within 48 business hours.
vi.Photos and video: who owns them
- Rubber City Studios keeps the copyright to the photos and videos.
- You receive permission to use them with no time limit to promote your business: your website, social media, menus, Google, print and ads.
- You may not resell the images or give them to another business to use as its own.
- We may show the work in our portfolio, unless you ask us in writing not to.
- You are responsible for having permission from your team and your customers to appear in the photos. If needed, we can give you a release form.
vii.Websites: who owns them
- Your domain is yours. If we register it, it goes in your name or we transfer it to you whenever you ask.
- Your text, logo, photos and data remain yours.
- Hosting is included as long as the monthly plan is current. If you cancel, we help you move your domain and hand over your content.
viii.CocinaLink and phone assistants
CocinaLink is also governed by its own Terms, published at cocinalink.com.
The phone assistants use artificial intelligence and can make mistakes. We recommend reviewing the appointments and orders they send you. You decide what information the assistant gives, and you are responsible for notifying your customers about recordings when the law requires it.
ix.Acceptable use
Our services may not be used for illegal activities, to deceive customers or to publish content that does not belong to you. We may suspend a service used that way.
x.Limitation of liability
To the maximum extent permitted by law, Rubber City Studios and its responsible party will not be liable for indirect, incidental or consequential damages, or for lost sales, profits or data. Total liability for any claim is limited to what you paid for the service in question during the 3 months before the claim.
xi.Termination
You can cancel a monthly service at any time, effective at the end of the month already paid. We may end a service with reasonable notice, or immediately if these Terms are violated.
xii.Governing law
These Terms are governed by the laws of the State of Ohio, USA. Any dispute will be resolved in the courts of Summit County, Ohio.
xiii.Changes
